Agreement to Terms

By accessing or using the StöKs Strategy website and services, you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you may not access our services.

Services Description

StöKs Strategy provides digital presence consulting and strategy services for small businesses, including but not limited to:

• Digital Presence Architecture
• Messaging & Positioning
• Content Strategy Development
• Outbound Engagement Planning
• Performance Analysis & Reporting
• Strategy Sprints
• Fractional CMO Support

User Responsibilities

You agree to:

• Provide accurate and complete information when using our services
• Maintain the confidentiality of any account credentials
• Use our services only for lawful purposes
• Not interfere with or disrupt our services
• Not attempt to gain unauthorized access to our systems

Intellectual Property

All content, materials, and deliverables created by StöKs Strategy remain our intellectual property until full payment is received. Upon payment, you receive a license to use the deliverables for your business purposes.

You may not:

• Resell or redistribute our strategies or frameworks
• Claim our work as your own creation
• Use our materials to compete with our services

Payment Terms

Payment terms will be outlined in individual service agreements. Generally:

• Discovery calls are complimentary
• Project-based work requires a deposit before commencement
• Ongoing services are billed monthly
• Invoices are due within 14 days of receipt
• Late payments may incur fees and service suspension

Cancellation and Refunds

Cancellation policies vary by service type:

• Discovery Calls: Can be rescheduled with 24 hours notice
• Strategy Sprints: 50% refund if cancelled 7+ days before start date
• Ongoing Services: 30 days notice required for cancellation
• Completed Work: Non-refundable once deliverables are provided

Confidentiality

We respect the confidentiality of your business information. We will not disclose your proprietary information to third parties without your consent, except as required by law.

Limitation of Liability

StöKs Strategy provides strategic consulting services. While we strive for excellence, we cannot guarantee specific business outcomes or results. Our liability is limited to the amount paid for our services.

We are not liable for:

• Indirect, incidental, or consequential damages
• Loss of profits, revenue, or business opportunities
• Results from implementing our recommendations
• Third-party platform changes or policies

Warranties and Disclaimers

Our services are provided "as is" without warranties of any kind. We do not guarantee that:

• Our services will meet all your requirements
• Our services will be uninterrupted or error-free
• Any specific results will be achieved

Indemnification

You agree to indemnify and hold StöKs Strategy harmless from any claims, damages, or expenses arising from your use of our services or violation of these terms.

Modifications to Services

We reserve the right to modify, suspend, or discontinue any aspect of our services at any time. We will provide reasonable notice of significant changes.

Governing Law

These Terms of Service are governed by the laws of the State of New Mexico, United States. Any disputes will be resolved in the courts of Santa Fe County, New Mexico.

Severability

If any provision of these terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
